Intellectual Property Policy

This Intellectual Property Policy (the "Policy") governs copyright, licensing, permitted use, restrictions, and infringement responses for everything TVIEW LAB (the "Service"), operated by VIBE MAKER (the "Company"), publishes or provides.

Terms not defined here take the meanings given in Terms of Service §2. This Policy is the detailed rule set for Terms of Service §8 (Intellectual property) and Terms of Service §10 (Prohibited conduct). The nature of the Service is described in the Disclaimer. Subscription rules are in the Subscription Terms.


§1. Copyright

All Content, and the expression, arrangement, and compilation of Content, on the Service is owned by the Company or by the rights holders from whom the Company has licensed rights. Copyright, database rights, editorial rights, trademarks, and other intellectual property rights are reserved.

In this Policy, "Content" includes without limitation:

  • TradingView Pine Script, custom indicators, and strategy scripts
  • Entry and exit rules, risk management rules, and parameter sets
  • Backtest results, quantitative research outputs, and datasets
  • Research reports, strategy reports, market analyses, and magazine articles
  • Chart images, visualizations, diagrams, and infographics
  • Documents, explanations, methodology, and educational content
  • Videos, PDFs, newsletters, API responses, and any other research output

Where we cite third-party materials, rights in those materials belong to their respective holders. Use of those materials is subject to applicable law and the original holders' terms.


§2. License scope

Your purchase of, or subscription to, the Service does not transfer ownership. It grants you a license to use the Content on the terms below.

The license we grant you is:

  • For personal use — limited to your own personal, non-commercial use.
  • Non-exclusive — we may grant the same or similar licenses to other users.
  • Non-transferable — you may not assign, sublicense, rent, or transfer the license (except where mandatory law explicitly permits it).
  • Non-resellable — you may not resell, redistribute, resubscribe, or share the Content with third parties for payment or otherwise.
  • Revocable — we may terminate the license if you violate the Terms of Service or this Policy.

The license is valid only for the paid period. When the paid period ends or the license terminates, you have no continuing right to use the Content.

Our product-license mapping:

  • Premium Membership — during the subscription period, license to use Premium Content. License ends when the subscription ends.
  • Individual report purchases — license to use the specific report you purchased, on the terms and duration stated at the point of sale.

In every case, intellectual property remains with the Company. It does not transfer to you.


§3. Pine Script, custom indicators, and strategy scripts

Pine Script, custom indicators, strategy scripts, and code we provide are the Company's research output. The following actions are prohibited:

  • Copying, storing, distributing, or sharing any part of the script or code
  • Modifying, editing, or combining the script or code to create derivative works (whether or not the derivative is distributed or sold)
  • Republishing or reselling the script or code under your name or a third party's name
  • Posting the Pine Script code to public repositories, communities, social networks, or chat channels
  • Extracting the script's logic, parameters, entry or exit rules, or risk management rules and reconstructing them as a separate work

You may use the script we provide in your own TradingView account for personal purposes. You must also comply with TradingView's platform policies and terms. Removing the script from the TradingView platform to external locations, or listing it on public marketplaces or repositories, is prohibited.


§4. Research reports, PDFs, and documents

Reports, research, backtests, magazine articles, newsletters, PDFs, and course materials we publish are the Company's copyrighted works. The following actions are prohibited:

  • Posting or distributing all or a substantial part of a report or document on websites, blogs, communities, social networks, chat channels, email, or file-sharing services
  • Downloading a PDF or document and forwarding or sharing it with third parties
  • Redistributing paid reports for free, or reselling them for a fee
  • Presenting our conclusions, data, tables, or graphs as your own work
  • Directly reusing our editorial arrangement, table of contents, or executive summary

Except for citation within the limits of applicable law, you may not copy, distribute, publicly transmit, or resell our reports, research outputs, or datasets without our prior written consent.

When you cite our Content within the limits of applicable law, we ask that you also:

  • Attribute the source: "Source: TVIEW LAB (https://tviewlab.com)" or an equivalent citation
  • Include a link to the original URL where feasible
  • Preserve the meaning of the original without distortion

Commercial use, use of substantial portions, or repeated or bulk use requires our prior written consent. Use beyond the limits of fair-dealing or fair-use exceptions may result in actions under §9.


§5. Images, charts, and visualizations

Chart images, visualizations, diagrams, infographics, screenshots, logos, and brand images posted on the Service are the works of the Company or the rights holders. The following actions are prohibited:

  • Downloading images or charts and reposting or redistributing them on third-party sites
  • Removing or altering watermarks, copyright notices, or source attributions
  • Using our images or logos in your own works, commercial materials, or advertising
  • Bulk collection or storage of images using automated tools

Individual, non-commercial reference use follows the citation conditions in §4.


§6. Datasets, APIs, and parameter sets

Backtest data, quantitative research outputs, datasets, parameter sets, and API responses we provide are the Company's database works. The following actions are prohibited:

  • Copying, storing, or redistributing all or a substantial part of a dataset or API data
  • Selling or sharing datasets or API data with third parties, for payment or otherwise
  • Extracting parameter sets or optimization results and incorporating them into your own work or service
  • Integrating our API into your service, application, or bot without a license
  • Circumventing rate limits or access controls to collect data

Even for personal, non-commercial use, the license scope and restrictions in this Policy apply.


§7. Automated collection, reverse engineering, and AI training

Automated access to and use of the Service and Content is prohibited within the following scope.

Automated collection and scraping

  • Bots, crawlers, scrapers, and scripts to access the Service or collect data
  • Headless browsers, proxies, or IP rotation to make repeated requests
  • Automated requests that circumvent API rate limits or access controls
  • Legitimate access by search-engine crawlers we have explicitly authorized is excepted

Reverse engineering and vulnerability probing

  • Reverse engineering, decompilation, or disassembly of the Service, scripts, code, or datasets
  • Attempts to bypass license validation, access controls, or payment verification
  • Probing or exploiting security vulnerabilities for malicious purposes

AI training and automated processing

Without our prior written consent, you may not use the Content (research outputs, reports, scripts, datasets, images, documents, API responses, and similar) for:

  • Pre-training or fine-tuning large language models
  • Generating embeddings or building vector databases
  • Building datasets for training AI models, whether for distribution or internal use
  • Learning or imitating the Content's style or editorial characteristics to generate similar content or a competing service
  • Any other automated processing or training-oriented use

This section defines the contractual scope of your license to use the Content. It does not affect uses that are expressly permitted by applicable law.


§8. Account sharing

Your account is for you alone. You may not:

  • Lend, transfer, or share your account, password, or login information with third parties
  • Allow multiple people to use one account sequentially or simultaneously
  • Provide access to paid Content to multiple individuals through one payment or subscription
  • Extend the license scope to teams, organizations, or study groups through a personal account

Teams and institutions require a separate Enterprise plan and an individual agreement. Contact us for details.

You are responsible for keeping your account credentials secure. If you know or suspect your account has been misused by a third party, notify us immediately.


§9. Copyright infringement responses (takedown)

If you believe the Service or our Content infringes your copyright.

Send a written notice to the address below including the following information (this format is consistent with the notice-and-takedown practice under 17 U.S.C. §512 (DMCA) and similar frameworks):

  1. Identification of the copyrighted work you claim has been infringed
  2. Identification of the material on the Service you claim is infringing, with a URL specific enough for us to locate it
  3. Your contact information (name, address, phone, email)
  4. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law
  5. A statement, under penalty of perjury, that the information in the notice is accurate and you are the rights holder or authorized to act on the rights holder's behalf
  6. Your physical or electronic signature

We review notices in good faith and respond as required by applicable law. We may remove or disable access to material we determine to be infringing. We terminate accounts of repeat infringers in accordance with applicable law.

Counter-notice. If your material was removed and you believe it was removed in error, you may submit a counter-notice with equivalent information. We forward counter-notices to the complaining party per applicable law.

If someone is infringing the Company's copyright. Please notify us at the same email with the URL, description of the infringing use, and your contact information. We take reasonable steps in accordance with applicable law.

We may pursue any of the following in response to infringement or violation of this Policy:

  • Written notice and request to stop
  • Temporary suspension of account access
  • Termination of paid licenses and subscriptions
  • Termination of membership and forced closure of the account
  • Legal action for damages, civil claims, and criminal referrals as appropriate

Nothing in this section limits any right granted to you by applicable law. Amendments to this Policy follow the process in Terms of Service §3.
